Prime Minister Narendra ModiThe hearing on a petition challenging clean chit to Prime Minister Narendra Modi and others in the 2002 post-Godhra riots case began in the Gujarat High Court on Tuesday. During the hearing, Mumbai-based activist Teesta Setalvad was also present in the courtroom, along with several riot victims. The petitioner, Zakia Jafri, whose husband ex-Congress MP Ahsan Jafri was among 69 persons killed in Gulberg Society massacre during 2002 riots, moved High Court in March 2014 after a metropolitan magistrate upheld the closure report filed by Supreme Court-appointed Special Investigation Team (SIT) that gave clean chit to all the accused, including then chief minister Narendra Modi (now the Prime Minister) and others.
Beginning the arguments, Mihir Desai, the lawyer appearing for Jafri, said that the revision petition is based on five major grounds. He said that the petitioner had demanded further investigation, other than the SIT, which was rejected by the metropolitan court, stating that it had no jurisdiction.

Besides, Desai argued that the lower court also didn’t consider other aspects of the case, such as larger conspiracy that began even before the Sabarmati Express train carnage case on February 2, 2002 in Godhra which resulted into riots on the very next day and was followed in other parts subsequently.
He said that even if riots broke out in reaction to train-burning case, the state machinery failed to control it. He alleged that the officials failed in discharging their duties, failed to imposed curfew and bringing Army on time. Giving the background of the case, Desai also said that while upholding the SIT closure report, the magisterial court didn’t rely on witnesses such as former IPS officers R B Sreekumar and Rahul Sharma, and suspended IPS officer Sanjiv Bhatt, among others.

Jafri moved the apex court after her repeated attempts for lodging an FIR were rejected by state authorities and the courts. The arguments will be continued on Wednesday.
