Delhi Police today told a local court that it has transferred to Lucknow a case lodged here against yoga guru Ramdev for his alleged comments that Rahul Gandhi visits houses of Dalits “for picnics and honeymoon”.

In the status report filed before Metropolitan Magistrate Muneesh Garg, the police said it has sent the case file to its counterparts in Lucknow for further probe as the place of occurrence of the incident was the Uttar Pradesh capital and a similar case was lodged there too.

The report filed by officials of Madhu Vihar police station, where the FIR was lodged, said that prior to this case, an FIR was registered at Mahanagar Kotwali Police Station in Lucknow under section 171(G) (false statement in connection with an election) of the IPC and under the provision of the SC/ST (Prevention of Atrocities) Act.

“The law is clear in this regard that for the same issue and against the same person trial cannot be conducted at different places and hence this case has been sent to SSP, Lucknow (UP) for further investigation as some other cases registered at different places on the same issue have also been clubbed with the case registered at Police Station Mahanagar Kotwali, Lucknow,” the report said.

Advocate Jitendra Kumar, appearing for complainant N B Gautam on whose complaint the FIR was registered here, opposed the police’s move of transferring the case saying the matter cannot be sent to any other state.

The counsel said when the FIR has been lodged in Delhi, the investigation should also be done here. The court has fixed January 24 for further proceedings in the case.

The FIR was registered at Madhu Vihar Police Station in East Delhi on July 10 under the provisions of the SC/ST (Prevention of Atrocities) Act.
The complainant said that the yoga guru had made the objectionable comments in April in Lucknow.

“Rahul doesn’t wants to marry a ‘desi’ girl, however, he likes going to Dalits places for picnic and honeymoon,” Ramdev had allegedly said.
The complainant had alleged that Ramdev knowingly made the comments and defamed Dalits.
