Arrest of Somnath Bharti’s brother led to protests and complaint against police in Jan, 2013

Delhi law minister Somnath Bharti’s diatribe against the police is nothing new. A year ago, he had given a mouthful to the Bangalore police who dared to register a case against his brother.

“We are not amused by the way he treated the Delhi police when they refused to raid a house on his instructions. Last year, he was literally ordering us what to do and what not to,” said a police officer who found himself at the receiving end in January 2013.

It was Arvind Kejriwal’s Aam Aadmi party (AAP) versus Bangalore city police a year ago. Loknath Bharti, an engineering graduate and brother of Somnath, was arrested by Bangalore police for allegedly threatening his landlord’s cook with a knife. He got bail from a magistrate on a Sunday, but not before AAP members staged a protest against the police for alleged custodial torture of Loknath. Police, however, blamed Loknath for not cooperating with them and claimed that he assaulted a police constable during his arrest.

Somnath had come to the rescue of his brother and blamed the Bangalore police for trying to divert attention from his earlier actions in Delhi. He had told Bangalore Mirror, “Bangalore police are acting at the behest of New Delhi police to divert attention. They are painting a bad picture about us to help Delhi police.” Somnath was then defending the eight people accused of killing Delhi police constable Subhash Singh Tomar, during protests near India Gate following the gang-rape of a 23-year-old.

HSR Layout police had arrested Loknath after a complaint by Ravindra Aneja, who ran a paying guest accommodation. Police had then said that Loknath was called to the station for counselling after threatening the cook. At the station, he allegedly assaulted a constable. The constable pushed him back when he turned aggressive and Loknath sustained injuries, falling on a chair, police said. After AAP protesters complained, police ordered an inquiry.

Somnath and Loknath then filed a complaint on January 14 against Loknath’s landlord for making false allegations and against police officers including a SI, and circle inspector for assault. The complaint was given to then additional commissioner of police T Sunil Kumar. A FIR was filed against the accused in the same police station. Police inspector R Vasu, who is handling this case, said, “The case is pending as the investigations are not yet complete.”

Somnath had demanded the police officers be booked charges of attempt to murder, criminal conspiracy, voluntarily causing grievous hurt and wrongful confinement. However, the FIR mentions voluntarily causing hurt, assault, wrongful confinement for extorting confession and threat.
