Respected Sir

I want to bring into your notice on an incident of uncalled-for and unwarranted firing by Central Reserve Force personal during the recent Panchayet election. The alleged incident was happened while the voters were in queue to cast their votes. There was commotion between the restless voters and poling party as the voters were waiting till 8 in evening and there was no adequate arrangement to speed up voting process. All of a sudden a CRPF personal fired from his firearm resulting death of a marginalized person, who was in queue to cast his vote.

The said firing has violated prescribed domestic norms and requisites for firing and subsequent actions as set by the National Human Rights Commission and in clear violation of United Nations Basic Principles on the Use of Force and Firearms by Law Enforcement Officials.

I am appending a detail which is self explanatory and demand for:-

1.  The action of CRPF personal must be tried by the local criminal court

2.  He must be booked under section 302 of Indian Penal Code. He also violated the section 9 (l) of The Central Reserve Police Forces Act 1949

3.  The NHRC guideline on encounter deaths must be followed in letter and spirit

4.  The victim’ family must be duly compensated

Name of the victim :-  Mr. Amal Haldar , son of Mr. Gayaram Haldar resident of  village- Ghoshaler Chawk, Post Office- Mayahauri, Police Station- Jaynagar, District-  South 24 Pargana, State- west Bengal.

Name of the perpetrator: –    Central Reserve Police Force (CRPF)

Place of incident:-  Darabapuli Chawk, Dara High School, Booth number- 100, under Joynagar ll Block, South 24 Pargana district, during recently held Panchayet election

Date and time of the incident:-  On 19th July 2013 at around 8.15 pm.

Case Details;- Mr. Amal Haldar  was an innocent resident of Ghoshaler Chawk village. By profession he was a daily wage labor and maintained his family with difficulty and financial constraints. Victim was the only earning member of his family including his father Mr. Gayaram Haldar, mother Mrs. Ekadashi Haldar, and wife Mrs. Tumpa Haldar.

It was revealed from our fact finding report that on 19th July 2013 victim was present at the polling booth (no- 100) situated at Dara High School to cast his vote. At even 8 pm, 400 people were waiting in the queue to cast their votes. Our fact finding report states that out of 1138 voters of that polling booth only 535 voters could caste their votes till 8 pm. Due to slow procedure and lethargy of polling staff, villagers were felt impatient and they started creating chaos in front of presiding officer of that booth. At that time, the police personnel presented at that booth resorted  lathi charge upon the innocent villagers. Due to this lathicharge a commotion broke between police and voters in queue. Suddenly one Central Reserve Police Force (CRPF) van came at the spot and one jawan fired from his riffle aiming at the crowd. Due to the firing; one bullet hit to the head of Mr. Amal Haldar and he fell down in the ground. He was sent to Nimpith Primary Health Center. At that Health Center the doctor declared him brought dead. The witnesses narrated that there was no provocation for firing and before the firing no warning was made and no magistrate was present at the scenario.

Mr. Tarun Naskar, Member of Legislative Assembly from Joynagar Constituency said that from morning we were asking for more polling staff for smooth polling. Due to fault of administration one innocent person was killed, who happened to be a supporter of our party SUCI.

The whole incident was witnessed by Mr. Nirmal Haldar, Mr. Kamal Mondol and Mrs  Kabita Haldar.   Later, the incident was registered vide Joynagar PS Unnatural Death Case No. 51/13 dated 19.07 2013.
