Madras HC dismisses Hindu organisation’s plea

The Madras High Court on Wednesday dismissed a petition by the Hindu Munnetra Kazhagam (HMK) seeking a direction to restrain the authorities from giving permission to the Tamil Nadu Muslim Munnetra Kazhagam (TMMK) or any other Muslim organisation to take out a procession on December 6 demanding the restoration of the Babri Masjid in Ayodhya.

Justice V. Ramasubramanian observed that when the court was trying to enforce the constitutional mandate of freedom of speech and expression and directing the State to grant permission, it was not open to the petitioner to use the same court to curtail the right. The grievance of the HMK, represented by its general secretary, K.Gopinath, was that if the TMMK’s procession and demonstration were allowed, it would destroy peace and tranquillity.

The Judge said that earlier the Hindu Munnani came up with petitions by S. Elumalai and K.Balu, who were office-bearers, seeking permission to hold demonstrations on December 6 at Tiruvennainallur and Villupuram demanding that a Ram temple be constructed at Ayodhya.

He had disposed of the petitions granting permission to the organisation. Once permission was granted to the Hindu organisation to hold a demonstration, it was completely unethical and unlawful to deny permission to organisations holding opposite point of view, Justice Ramasubramanian said.
