Woman Says Investigating Officer Harassed Her
A woman who has accused the policeman probing her rape complaint, of harassing and passing lewd comments, also claimed she was made to wait till late in the night to file an FIR, in contravention of Supreme Court guidelines.In March, the woman who is divorced and has two children, filed a complaint with the MHB police station alleging that 24year-old Shyam Kumar had raped her and duped her of cash and gold worth Rs 5 lakh. She soon complained of lewd behaviour by the investigating officer Anil Avadh. “ According to the Supreme Court’s guidelines, a lady police officer should have been investigating my complaint of rape and cheating. I was made to sit in the police station on two consecutive days and the FIR was registered only on the second day at 12.30am despite the guidelines clearly stating women should not be detained in a police station after dusk,“ the woman said.“Shyam told us he will be available after May 5, the last day of his exam. So we did not arrest him. The woman felt police were helping the accused and she made this wild allegation. I have sought permission to file a defamation case against her,“ claimed Avadh.

“We have received a complaint against Avadh. I have ordered an inquiry and assigned the case to DCP Supriya Pathak, who will probably take charge on Monday ,“ said joint commissioner (law and order) Deven Bharti. Senior inspector Subhash Chauhan refused comment.

In her complaint of rape, the woman alleged she met the accused during Sunday mass after which they stayed in touch and he visited her home on occasions. Shyam was then studying engineering in Kerala. Last November, he reportedly messaged her to say he was returning from Kerala and requested her to pick him up from Thane station. They went to her house where Shyam offered her mineral water and she reportedly fell unconscious on drinking it.When she regained conscious ness and realised she had been sexually assaulted, she protested at which Shyam promised to marry her. He maintained physical relations with her but when she was pregnant, she alleged Shyam took her to a clinic in Borivli, posing as her husband, and forced her to have an abortion.

Moreover, he extracted Rs 5 lakh from her on several pretexts. The woman realised she was duped when in March she confronted him about marriage. She claimed she even called up Shyam’s mother and complained about him, following which his elder brother threatened her.

Rogue elements in the police force seem to have learnt no lesson from the Saki Naka episode.There can be no greater slur on the system than an officer, who has been entrusted with the probe into a case of alleged rape, stalking and harassing the complainant. Allegations like this erode the citizen’s faith in police. Seniors must do whatever they can to check the rot. And it should start with this case, with a fair probe into the allegations and exemplary punishment if they are proved true.
