Four policemen from different police stations in the city have been booked for culpable homicide not amounting to murder after Mahendar Rathod (42), a native of Odisha, had died in their custody last year. Rathod was picked up for questioning in a case of theft at his employer’s house.

The incident happened on March 19, 2016 and all the four policemen were working at the JB Nagar police station then. Rathod was working as a cook and gardener at the residence of a businessman in HAL II Stage. He had filed a complaint, suspecting Rathod’s involvement in the missing cash worth Rs 3 lakh. The four policemen had brought the man in for questioning, but within a few hours, he had allegedly died in police custody.

The case was taken over by the CID, which recently submitted its report. The CID report had found the four policemen (head constable Ejaj Khan and constables, Keshava Murthy, Siddappa Bommanahalli and Mohan Ram) guilty. Apart from IPC 304 (culpable homicide not amounting to murder), the four were booked for voluntarily causing grievous hurt by dangerous weapons or means (IPC 326), and voluntarily causing hurt by dangerous weapons or means (IPC 324).
The complaint was registered by BS Srinivas, DySP, Homicide and Burglary division, CID, on Monday, with the JB Nagar police, said a police officer, adding that the cops were yet to be arrested “The CID also checked the CCTV footage from inside the police station. It was found that Rathod, while being brought to the police station, was fine. The problem began after he was taken behind the police station and there was no footage of that area. He was then moved to a private hospital. After the death, the four policemen had been placed under suspension. However, inspector Hitendra and sub-inspector Rajshekar were given a clean chit by the CID as they were on special duty,” the officer said.

The CID is in the process of summoning the four accused policemen. They have the powers to arrest the policemen and produce them before court, the JB Nagar police said.
