Anil Agarwal, Vedanta Boss – APOLOGISES to Zambia

VEDANTA Resources chairperson Anil Agarwal has rendered a full apology to Zambia for boasting that he bought Konkola Copper Mine (KCM) ‘for a song’, Parliament heard yesterday.

Mines, Energy and Water Development Minister Christopher Yaluma informed the House that despite Mr Agarwal’s apology, the matter was still being investigated following the establishment of a legal team.
A leaked YouTube video in May this year, showed Mr Agarwal boasting that “KCM was bought for a song”, a matter which a legal team led by Secretary to the Treasury Fredson Yamba, was still studying.
KCM was sold to Vedanta Resources in 2004 at a cost of US$25million from a sale price of US$400 million.
“Vedanta Resources through its chairperson Agarwal had rendered a full apology to the Government, however, his comments are still being reviewed by our legal team set up to look at this matter,” Mr Yaluma said.
Mr Yaluma was responding to Kabompo West UPND Member of Parliament (MP) Ambrose Lufuma who wanted to know whether Government had intentions of summoning the Vedanta chairperson over the matter.
The Mines Minister added that the Zambia Revenue Authority (ZRA) would seek assistance from foreign firms in its continued monitoring of events at KCM, following evidence of gross mismanagement by Vedanta Resources.
This was a response to UPND Mazabuka Central MP, Garry Nkombo who asked whether Government would consider engaging international firms such as Scotland Yard to probe KCM operations particularly in tax evasion.
Mr Yaluma said the ZRA was capable of addressing the matter but did not rule out engagement of foreign firms to render assistance.
Audit revelations had shown that KCM management had failed to run the company effectively but that Government had taken stringent measures to ensure the mining giant did not collapse.
Meanwhile, Vice- President Guy Scott told Parliament that several heads of State had indicated that they would attend Zambia’s Golden Jubilee Independence Anniversary on October 24.
Dr Scott said the preparations for the Golden Jubilee had reached an advanced stage and were being steered by the National Steering Committee chaired by Secretary to the Cabinet, Roland Msiska and the Zambia @50 Secretariat.
Dr Scott said this when he delivered a ministerial statement to inform Parliament on the preparations for this year’s Independence celebrations, which were officially launched during last year’s Independence Day commemorations.
“I wish to advice that following Cabinet approval of proposals to invite heads of State and government, the Ministry of Foreign Affairs has sent invitations to inter-alia other countries in the Southern Africa Development Community to attend Zambia’s Golden Jubilee celebrations. Several heads of State have showed that they will come to attend the celebrations,” he said.

Vedanta Resources Chairman Anil Agarwal expects the new governmentto adopt reforms and forward-looking policies for unlocking the untapped potential of the country’s natural resources sector.

“We expect the new government to have clear reforms and forward looking policies on top of their agenda that can open up this sector’s potential to contribute and strongly impact the GDP growth of the country,” Agarwal said in a statement.

Though the country has abundant reserves of oil & gas, bauxite, coal, iron ore, copper and gold, it is spending multi-billions of dollars on imports, he said.

India’s imports dipped 8.11 per cent to USD 451 billion in 2013-14.Natural resources, including oil and gas, contributed a significant part in the total basket.

A new government with Narendra Modi as Prime Minister in the Centre is slated to take office on May 26.

“We should explore, produce and utilise our natural resources optimally in the most sustainable and environment friendly manner. Hundreds and thousands of large, medium and small scale industries can be set up across the nation to process our raw material and build infrastructure, this can create significant opportunities for employment,” Agarwal said.

The London Stock Exchange-listed Vedanta Resources has business interests in areas such as oil and gas, aluminium, zinc, copper and iron ore, among others.

The good news is that Vedanta continues to slump, as the Sunday Times rich list reports a half a billion pound loss to Agarwal’s wealth in the last few months, describing him as a metal-to-oils tycoon, which demonstrates his shift towards the oil industry as his metals industry faces increasing resistance from local activism and court hold ups.

A video(1), released by activists from Foil Vedanta(2) today, shows Vedanta boss, and 69% owner, Anil Agarwal, telling a large audience how he bought Konkola Copper Mines for just $25 million, rather than the $400 million asking price, and receiving loud cheers when he states that the company brings in $500 million in profit each year. Foil Vedanta had previously released figures from Vedanta’s annual reports showing that the company made $362 million in 2013(3), but Vedanta CEO Tom Albanese(4) had disputed this during his visits to Zambia in February, repeating the previous claim that KCM was making a very low profit or a loss due to high operational costs and taxes.(5)

In the video, Agarwal, speaking to the Jain International Trade Organisation(6) in Bangalore, India, March 22 – 23 this year, states about KCM:

Its been 9 years [since we’ve owned the company], and since then every year it is giving us a minimum of 500 million dollar, plus 1 billion dollar, every year it has been continuously giving back.”

Anil Agarwal also explains in detail how he came to buy ‘the largest copper mine in Africa’ at Konkola, describing how he took a chance by offering only $25 million rather than the $400 million asking price. He describes his surprise at receiving a VIP welcome in the Zambian parliament, and ridicules the then Zambian President Levy Mwanawasa for claiming that Vedanta would improve the lives of Zambians, saying:

He told the entire parliament that what great people we are, and our empire, and that they will make our lives gorgeous. And they will make schools, make hospitals and blah blah …”

A few weeks ago a protest at the Zambian High Commission in London called for Vedanta and the Zambian government to release KCM’s annual reports, containing the official figures on profits and tax payment, which are currently kept secret.

They also suggested that Vedanta should be forced to pay the fine of $2 million served by Zambian courts in 2011 as compensation to 2000 claimants poisoned by major pollution of the river Kafue in 2006, and stop ongoing spills affecting Chingola residents. (7)

In addition they joined the calls of KCM employees and former employees in Zambia, who are demanding that retrenched workers are properly compensated for taking redundancy, and existing contract labourers are unionised.(8)

Meanwhile Vedanta’s Lisheen mine in Ireland, which they bought from Anglo American in 2011, is facing trouble, as a High Court judgement has ruled that three senior managers should be paid 6 months sick pay after leaving the company due to ‘bullying, harassment and intimidation since Vedanta took control’. Local councillors, as well as the aggrieved managers, are also questioning Vedanta’s decision not to wind the mine down by 2015, as they had originally planned.(9)

Mr Albanese said the profit and loss accounts of KCM are transparent. He said audit reports which are thoroughly scrutinised are made available within the country and outside.

On behalf of the shareholders and subsidiaries of Vedanta, the reports are prepared according to Zambia, United Kingdom and United States (US) financial regulations,” Mr Albanese said. He said despite KCM making profit, most of it is lost to taxes and operational costs.

In 2006 KCM spilled effluent into the Mushishima stream, and the Kafue river, raising chemical concentrations in the river Kafue to 10 x acceptable levels of copper, 770 x manganese and 100 x cobalt. Thousands were poisoned, and a litigation on behalf of 2000 Chingola residents by private lawyers resulted in a landmark $2 million fine being delivered by judges in 2011 to be paid to the claimants1. However, Vedanta challenged the ruling and the case is yet to be re-heard while the fine remains unpaid. Affected residents are now experiencing birth deformities and severe health problems, while the Mushishima stream remains regularly contaminated by the KCM mine, leaving communities without clean water and suffering ongoing health problems. (8) The Former KCM Miners Association is a union of workers retrenched from KCM since 2000. They are 752 in total, and 235 of them were retrenched during Anglo American’s ownership of KCM (2000 – 2004). None have received the full severance pay they were entitled to, while those fired under Anglo have received nothing at all. The group have been campaigning on this issue for many years.

NEW DELHI: CBI has registered a preliminary enquiry against Vedanta Group Chairman Anil Agarwal in connection with alleged irregularities in the disinvestment of Hindustan Zinc LtdBSE -2.41 % (HZL) during the period of NDA government.

The agency believes that the loss caused to the exchequer due to the alleged irregularities runs into hundreds of crore.

The preliminary enquiry is against Agarwal and unknown officials of HZL, Ministry of Disinvestment and Ministry of Mines,  .CBI sources said.

Vedanta spokesperson did not respond to queries in this regard.

It is alleged in the inquiry that Sterlite IndustriesBSE 2.79 %, part of Vedanta Resources, had picked up stake in the public sector undertaking at an undervalued price resulting in the estimated losses running into hundreds of crore to the exchequer, CBI sources said.

BHUBANESWAR: Trade union leader Dwarika Mohan Mishra here on Thursday accused the state government of providing ‘illegal’ protection toVedanta Group chief Anil Agarwal in a cheating case registered against him in 2008.Addressing a press conference, Mishra also accused the government of misleading the governor on the state Lokpal’s investigation into land acquisition for Vedanta’s proposed Rs 15,000-crore multi-disciplinary university in Puri district.

On November 16, 2010, the Orissa high court had quashed land acquisition proceedings for the controversial varsity project on grounds that those were ‘illegal’ and ordered for return of acquired land to its owners. The state government had acquired 3,495.21 acre of private land and leased another 509.27 acre of government land for the proposed varsity, as against a requirement pegged at 6137.90 acre.

“In May 2008, the Capital police station had registered a case on the direction of a local court after I filed a petition that the Anil Agarwal Foundation had submitted forged and fictitious documents to the state government regarding its ‘public limited company status’ to enable the state government acquire land for the university project,” Mishra said.

“The governor’s office had asked the state government for a status report/ action taken report concerning the case on July 3 and November 28. But it has not acted on it,” he added.

Under the law, the government could acquire private land only for a ‘public limited company’, but when land acquisition was notified for Vedanta’s varsity project the Foundation was a private limited company, Mishra said.

In March 2010, the then Lokpal Justice P K Patra had recommended the state government to appoint a competent authority to inquire into various acts of omission and commission perpetrated with regard to acquisition of land for the proposed university. It had come down heavily on the state government’s handling of the issue, especially the “illegal” acquisition of land belonging to Puri‘s Jagannath Temple for the promoter, Anil Agarwal Foundation, whose conversion from being a “private company” to a “public company” was shrouded in controversy. It had also recommended action against people, including senior bureaucrats, who had advanced Vedanta’s cause by throw laws to the wind.

Sulphur Dioxide leak grounds residents in Chingola, Zambia

KCM ChingolaThis report comes from local residents and research direct from Zambia where a Foil Vedanta team is currently investigating British based Vedanta’s copper subsidiary KCM and making links with Zambian communities.

In the early morning of Friday 13th December high levels of Sulphur Dioxide were released from Vedanta subsidiary KCM’s Nchanga copper smelter in Chingola, Zambia. KCM’s Public Relations manager Joy Sata (a former journalist for Daily Mail Zambia) warned affected communities to stay in their homes until the pollution passed. See news article below.

Sata was quick to point out to the media that the pollution was caused by a national power outage due to disruption at the Kafue Gorge Power Station run by the government power company ZESCO. However, this does not explain why KCM’s smelter was the only one of many other mining companies affected by the power cut to release toxic emissions into the local community. It is clear that KCMs back up power supply was not effective causing their production to stop and releasing damaging emissions.


One local man commented on an online article on the leak saying:

This Sulphur Dioxide is released even without a power failure. Vedanta resources has failed us and they MUST go!

kcm-logoVedanta’s KCM uses around 13% of Zambia’s electricity, or 250MW. Like other foreign mining companies in Zambia, Vedanta negotiated incredibly low energy prices in the secret Development Agreements they signed with the Zambian government in 2004. Most other mining companies have submitted to government negotiation and agreed a raise in prices, but Vedanta has refused, insisting that the prices remain the same until their 15 year fixed agreement ends in 2020.

Nearby Chingola we met members of Shimulala and Helen communities, which are located just downstream of KCM’s tailings dam 2. The water in their local stream is too polluted to drink, and even the borehole which KCM drilled for them after complaints is also highly polluted. This has left them without any fresh water supply and resident are forced to drink dirty water from a shallow borehole they have dug in some marsh land. Interestingly, our Foil Vedanta team have found that at all levels of community, government and even academia here in Zambia people believe Vedanta is an Indian and not a British company. They have been surprised to discover that a British entity could operate with such a pattern of illegalities and pollution.

Recent reports also revealed that KCM’s pollution of local water sources has become so acute that the Bulangililo Water Treatment Plant, which supplies 60% of water for the highly populated Kitwe district may have to be closed.

This news will be of little surprise to those following Vedanta’s legacy in India, where their subsidiary Sterlite released high volumes of sulfur dioxide from their copper smelter this March, bringing 5000 people into the street in reaction, and leading to temporary plant closure. Sterlite is one of many Vedanta subsidiaries which has followed a pattern of operating and expanding without permits, dumping toxic waste, polluting water and causing workers’ deaths.

There is worse news Vedanta as their share price has dropped to an all time low of 786 pence, with India’s Business Standard newspaper attributing Vedanta’s woes to people’s protests, court cases and regulatory hurdles. The revelation in Zambia that Vedanta is in fact a British company may bring more discredit to Vedanta’s name.

New Delhi: Billionaire Anil Agarwal, who controls London-based Vedanta Resources Plc., said he regrets investing $8 billion in an aluminium complex in India that’s faced a shortage of raw materials.
“I could either invest in Vedanta Aluminium or I could have bought Asarco,” Agarwal said in an interview with Bloomberg TV India in New Delhi aired on Friday. “I would have done better if I had bought Asarco. It would have been a feather in my cap.”
Regarding the investment into Vedanta Aluminium, Agarwal said: “If you ask me today, I regret it.”
Complex government procedures are delaying project approvals in India, impeding businesses, Agarwal said. His Sesa Sterlite Ltd has seen its iron-ore business slump following court-imposed bans to curb illegal mining, while the group’s failure to obtain a mining permit for bauxite in the eastern state of Odisha has driven the aluminium unit into losses.
Industrialists including Agarwal, Naveen Jindal and Kumar Mangalam Birlahave faced project delays in India.
Vedanta lost a bid in 2009 to acquire bankrupt US copper miner Asarco Llcfor more than $2.5 billion, cheering investors and boosting the company’s stock. Now, Vedanta Aluminium is running below capacity after failing to get approval from local tribes to mine bauxite.
Indian difficulties
Asked if doing business in India is more difficult than elsewhere, Agarwal replied: “That’s for sure.”
His employees have to run from table to table for permission to re-open the company’s iron-ore mine in the southern state of Karnataka, months after a court partially lifted a ban on mining there, he said.
India, which exported 101.5 million tonnes of iron ore in the year to March 2010, banned mining in two of the nation’s biggest producing states in August 2011 and September last year as it probed charges of illegal mining. Exports dropped to 18 million tonnes in the year ended 31 March, while companies have been forced to import, according to the Federation of Indian Mineral Industries. The court-ordered bans have since been eased.
India has the potential to produce as much as 700 million tonnes of the steel-making ingredient if it simplified its policies and quickened approvals, Agarwal said. The nation produced about 140 million tonnes in the year ended 31 March.
Agarwal said he plans to devote most of his personal wealth to philanthropy. In particular, he said, he wants to eradicate malnutrition in India. BLOOMBERG

Niyamgiri hills, home to 8,000-odd Dongria Kondhs, tribal group, a few hundred Kutia Kondhs and other forest-dwellers who eke out a living cultivating pulses, paddy and collecting naturally-grown horticultural crops, is considered sacred by the indigenous tribes and others as it is the abode of Niyamraja – their presiding deity.

Ministry of Environment and Forests (MoEF) had rejected (Stage-II /final approval) Forest Clearance on 24.8.2010 for the Bauxite mining on the basis of issues outlined by the Forest Advisory Committee which stated that ‘the Primitive Tribal Groups were not consulted in the process of seeking project clearance and also noticed the violation of the provisions of Forest Rights Act, the Forest (Conservation) Act, 1980, Environmental Protection Act, 1986 and also the impact on ecological and biodiversity values of the Niyamgiri hills upon which the Dongaria Kondh and Kutia Kondh depend’ and the detailed report of Naresh Sexana Committee specially appointed to look into the issue. This MoEF Order was challenged in a petition at the Supreme Court of India by Orissa Mining Corporation.

The Supreme Court of India had decided on 18 April 2013 that if Bauxite Mining Project of Vedanta affects the religious right of Schedule Tribes and other Traditional Forest Dwellers like Dongaria Kondh, Kutia Kandha and others over the Niyamgiri hills in Odisha ‘right has to be preserved and protected’. The Court has left it to the Gram Sabhas to decide if such right is affected by the proposed mine.cts.

In India  first time an environmental referendum was conducted on a directive by the Supreme Court to find out whether mining in Niyamgiri will tantamount to an infringement of the religious, cultural, community and individual rights of local forest-dwellers. During July-August this year, 12 gram sabhas, selected by the Odisha government for the referendum on mining in Niyamgiri hills, had rejected the proposal. The tribal villages, located on the hill slopes, are part of Rayagada and Kalahandi districts.


1.   The first  village council  was held at Serakpadi village of Raygada district.  In the sabha 36 out of 38 voters in the first Palli Sabha in Niyamgiri have voted against mining in Niyamgiri.

2.T he second, three hour long ,  village council meeting at Kesarpadi in Rayagada district-, in which -Thirty-three of 36 eligible voters , including all 23 women, voted against bauxite mining……At the three-hour-long sabha, 33 of 36 adult voters from Kesarpadi  unanimously adopted a resolution as per the Forest Rights Act, conveying their opposition to mining in the Niyamgiri hills.

3  The third village council meeting was held in a non -tribal forest hamlet of Tadijhola, which is imporant note also  unanimously rejected proposed bauxite mining in the Niyamgiri hills t.Nineteen of the 22 voters in the village were present  including eighty-seven year old Sugri Gouda. Hard of hearing and barely able to stand on her own, she insisted on signing the resolution before leaving the meeting venue. Three bare words she uttered drew a cheer from those present: “Niyamgiri dibu nai” (won’t give up Niyamgiri). Gauda was the also most sought after by media, with a slew of video cameras following her fragile steps as a family member walked her home.

4.  The villagers of Kunakeda, a Dongaria Kondh village in Kalahandi district, today unanimously rejected the proposal for mining in Niyamgir..All 21 out of 22 voters, who attended the meeting, voiced their opposition to Vedanta .

5  The 5th village coucil meeting w s held at Palberi, where .Fifteen of the 16 adult voters from the forest village were in attendance. and voted out vedanta.


6 The sixth Pali sabha , Batudi rejected settlement of community forest claims in Niyamgiri ,  31 among 40 voters from the hamlet in attendance, also rejected a joint verification report to settle community and religious rights to the forests granted under the Forest Rights Act of 2006.

7  The seventh village council , Phuldumer – again voted unanimously to reject Vedanta’s mine.—49 of the 65 listed voters were present to voice their opinion, in the meeting.

8  Ijurupa  village council meeting was a CLASSIC ,  where there is just a famiily, and the  four  members of te family nailed down a 72 MT mining proposalvillage in Kalahandi district, Odisha

9   At Lamba ninth pallisabha ,Braving intermittent rain, the 38 voters in the remote village, ousted Vedanta

10.The largest village council fo 12 villages , Lakhpadar village under Kalyansinghpur of Rayagada district located on the slopes of Niyamgiri, the 97 Dongaria Kondhs present in the pallisabha unanimously rejected the proposal to mine the hills for bauxite.

11. Khambasi village in Rayagada district , was the  the eleventh palli sabha , which  also unanimously opposed Vedanta

12-   On August 19th In Jerapa, 16 out of 26 voters, including 10 women, gathered at the final Palli Sabha on Niyamgiri. Under heavy police presence, and in heavy rain, they repeated the statements given in previous meetings – that they opposed the mine and would not leave the mountain no matter what. The twelve voters said they were ready to face bullets to prevent the digging of their sacred mountain.

On August 19th, NDTV and VEDANTA LAUNCHED the ‘ our girls our pride’ campaign. Coincidence ?


While our friends at  FOIL VEDANTA protested on the streets of london , On August 1st at the AGM  of Vedanta , When asked about Lanjigarh refinery and the scandal that is the attempted Niyamgiri mine, Anil Aggarwal ,  responded with a dreamy speech about believing that Niyamgiri was meant for Vedanta. he talked about hearing about Kalahandi as a child – a ‘black spot’ on India, and its ‘poorest poorest place’, and how he’d always wanted to do something about it. He said:

“We took courage to go there, no road even or bridge, it was all isolated, we created infrastructure, 7000 got work, not a blade of grass was moved in Niyamgiri .”

अम्नेस्टी इंटेनाटिओनल की रिपोर्ट के मुताबिक ओरिसा मे डोंगरिया कॉंड समुदाय का मानना है की वेदांता प्रॉजेक्ट के कारण उनका समुदाय विलोपन की कगार पर आ जाएगा दूसरी ओर वमसाधारा नदी मे वेदांता अलमुनिूम रेफीनिरी के वेस्ट मॅनेज्मेंट प्लांट के फेल हो जाने से , सारा ज़हरीला लाल कीचड़ नदी मे बह आया है , सारी नही दूषित हो गई ! आस पास के कई समुदाय और प्रांत उस पानी को पीते थे , उसी पानी से जाने कितने पंछी , जानवर और पानी मे रहने वाले जीव अपना जीवन यापन करते थे ! कुछ नही रहा , कोई कदम नही !

सुप्रीम कोर्ट के आदेश पर जब नियँगिरि मे आदिवासी वेदांता के खिलाफ एक जुट हो रहे थे  उन्ही दिनो वेदांता ने NDTV  के साथ जुड़ “हमारी लड़किया हमारा गौरव” लॉंच किया ! सारे विश्व मे हो रही अपनी बदनामी से मूह छुपाने के लिए वेदांता ने यह चाल चली ! वेदांता फेकिंग हॅपीनेस ने  NDTV  एवम् प्रियंका चोपरा के नाम ऑनलाइन पीटीशॅन लिखी के वो अपना नाम ” हमारी लड़किया हमारा गौरव ” से वापिस ले लें ! इस पीटीशॅन को पूरे विश्व भर मे सराहा जा रहा है और वेदांता की काली करतूतो के खिलाफ हज़ारो लोग रोज़ जुड़ रहे है !

वेदांता भारत ही नही पर भारत के बाहर भी कई घूसखोरी के आरोपो से घिरा पाया गया , और जहाँ आरोप साबित हुए , पकड़ा भी गया ! भारत मे आदिवासियों की ज़मीन हथियाने मे वेदांता ने पी एच डी प्राप्त की , सीसा गोआ मे कई बार वेदांता पर भू माफिया के साथ मिल कर अवैध खनन के आरोप लगे ! कर्नाटक मे भी यही गाथा दोहराई गई !

वेदांता के हर प्रॉजेक्ट मे मानवाधिकार की बलि चड़ी ! जिन परिवारों को वेदांता ने लूटा , ज़मीने छीनी , जिन मजदूरो का  मानवाधिकार हनन हुआ , उनको या उनके बच्‍चों को कोन सी ” खुशी” देगी  वेदांता ?

आदिवासीओं के खून मे लिप्त वेदांता आप के नाम के पीछे अपनी काली करतूतों को छुपाने का घिनोना प्रयास कर रही है !

Join  FAKING HAPPINESS CAMPAIGN  in wishing  Dr Prannoy Roy of  NDTV  on his birthday,  on 15th Oct 2013 , and hope he withdraws VEDANTA form the our girls our child campaign , in the  name of TRUTH, as he claims  for his 24 x7 channel .

Faking happiness campaign came into being last year when Vedanta launched its first CSR social media campaign called khushi- creating  happiness, which was a complete sham and facade. 

 “Creating Happiness” – a series of short films about Vedanta that aired on 37 TV channels – was an advertising campaign conceived by India‘s ad guru Piyush Pandey of Ogilvy & Mather. It was launched  last year with a technically slick film that focused on the apparent happiness of Binno, a small girl in Rajasthan, when she discovers that she can get an education from the anganwadis (child day care centres) set up by the company.

The company announced an initiative for students at media and film institutes to produce short films about the company that would then be judged in competition by a heavy-weight jury consisting of Pandey, actor Gul Panag and noted director Shyam Benegal who had championed “art cinema.” (Benegal’s early films realistically depicted feudal conditions in rural India).

Following our campaign  Benegal and Panag withdrew from the jury saying they were unaware of Vedanta’s role in the competition.  We had our own competition .” Blog posts, short films, cartoons and spoofs poured in on Facebook and YouTube that charged Vedanta with falsehoods.

Once again when NDTV  launched ourgirlsourpride campaign we are back in action .

 Our two petitions to Priyanka Chopra and Prannoy Roy have crossed the 2000 mark, and its amazing to see the voices and support not only from india but from world over, there are signatuers from USA, Pakistan, Iran , belgium, italy , Japana, China, UAE, South Africa, Canada
