Jan Samvaad on Right to Information and Lok Shikayat 

 

 

 

Over the last two months, three people have been murdered in Bihar for their use of the Right to Information. The brutal and cold-blooded murders of Valmiki Yadav, Dharmendra Yadav and Rajendra has shocked us all. They have been killed for raising their voice against local corruption in government schemes. Even as they used the RTI to unearth wrongdoing, local power nexus’s harassed and ultimately murdered them. This state of affairs is unacceptable. Considering that the Government both at the Centre and in Bihar, came to power on a plank of good governance and anti-corruption this complete disregard for citizen champions is even more alarming.

 

In a one-day Jan Samvaad organized by a consortium of organisations and campaigns working on issues of social accountability- Jan Jagran Shakti Sangathan, the National Campaign for Peoples’ Right to Information, Digital Empowerment Foundation and Video Volunteers a fact finding report on the murder of Valmiki Yadav and Dharmendra Yadav was presented. The families of these whistleblowers also attended and shared the repressive atmosphere under which their relatives were fighting against corruption. Rajesh Ranjan, the son in law of Rajinder Singh who was killed in Jamui said that everyone in the local administration knew that he would be killed one day but made no protection available. Apart from the experience of these slain RTI activists, several other RTI users put forward their experiences with accessing the RTI and the harassment that they have to face in seeking information on public programs.

 

Ashish Ranjan of NCPRI said “citizens who do raise their voice against corruption are being targeted, instead of being provided protection”. The Right to Information (RTI) Act is very poorly implemented with long delays, weak and ineffective Information Commission and shoddy replies to RTIs. Nikhil Dey, RTI activist added that “this is reflective of the mood at the national level where attempts are being made to weaken all transparency and accountability measures through amendments to the prevention of corruption act and the non-implementation of the Lokpal Act. Despite promises by the ruling party at the centre to introduce a comprehensive grievance redress law, no progress has been made so far”

 

A collective demand that arose from this meeting is for the immediate justice to the families of the murdered RTI activists and arrest of the accused. Secondly, the information being sought by these activists must be made public. Third, the state information commission needs to be strengthened, five commissioners must be appointed and penalty provisions of the law must be implemented. Fourth, The Whistle-blower Protection Act must be notified and implemented. Fourth, civil society organisations have pledged to come together to form a state solidarity network to support RTI users across the state and create an online platform on which the details of ths

 

In the midst of this gloom, Bihar is the first state in the country to have provided a legal framework to the redressal of grievances via the ‘Bihar Right to Public Grievance Redressal Act (BRPGRA), 2015’. Several individuals and groups have made use this law over the past few months in Araria, Katihar, West Champaran, Arwal, Aurangabad and Vaishali, to spread awareness, educate citizens and access entitlements. Some cases were presented where the law has been used to positive ends such as payment of the second instalment of PMAY and old age pension payment but in several cases, complaints have not been resolved despite officials orders which state that the matter has been redressed and closed. Many cases of stopped pension remain unresolved (such as Phoolmati Devi from West Chamaparan) and complaints on dysfunctional health centres (complaint of Pankaj Kumar from Arwal) were dismissed on flimsy grounds without any actual investigation.

 

In order to strength the GR law, demands for holding shikayat shivirs at a block level, sample checks of complaints to determine actual resolution and satisfaction, establishment of information and facilitation centres were amongst the demands raised. Anjali Bharadwaj of the Satark Nagarik Sangathan and NCPRI called for “establishing an independent commission for monitoring the implementation of the law”. Hearings must also be made public instead of individual.

 

The meeting concluded with a discussion on how to strengthen the national legal framework for accountability with specific contextualisation for each state.

100 से अधिक आर.टी.आई कार्यकर्ताओं ने जानकारी, सुनवाई, भागीदारी,कारवाई और सुरक्षा की मांग

सूचना के अधिकार पर कोइ बदलाव मंजूर नहीं

शिकायत निवारण कानून को सशक्त किया जाए

हत्या होने पर किया जाए “स्पेशल ऑडिट”

4 अगस्त, पटना | सूचना का अधिकार और लोक शिकायत कानून पर पटना के ए.एन.सिन्हा सामाजिक शोध संस्थान में जन संवाद का आयोजन हुआ | प्रख्यात सामाजिक कार्यकर्ता और सूचना का अधिकार कानून बनाने में महत्वपूर्ण भूमिका निभाने वाले निखिल डे और सेवानिवृत न्यायाधीश जस्टिस राजेन्द्र प्रसाद शामिल हुए | इस संवाद में राज्य भर से आये 100 से ज्यदा आरटीआई कार्यकर्ता और लोक शिकायत कानून को इस्तेमाल करने वाले लोगों ने भाग लिया. इस बैठक में पूर्वी चंपारण में मारे गए राजेन्द्र सिंह और जमुई में मारे गए वाल्मीकि यादव के परिवार के सदस्य शामिल हुए |

ज्ञात हो कि बिहार में पिछले 2 महीने के अन्दर सूचना का अधिकार इस्तेमाल करने वाले तीन आरटीआई कार्यकर्ता की निर्मम हत्या कर दी गयी है | 19 जून को पूर्वी चंपारण के आरटीआई कार्यकर्ता राजेन्द्र प्रसाद सिंह हत्या हुई और 1 जुलाई को जमुई में वाल्मीकि यादव और धर्मेन्द्र यादव की हत्या कर दी गयी थी तीनों लोग अपने इलाके में चल रहे विकास योजनाओं की निगरानी कर रहे थे और अपने प्रखंड एवं पंचायत स्तर पर हो रहे भ्रष्टाचार का विरोध कर रहे थे | इसलिए उन्हें धमकियाँ मिली और फिर उनकी हत्या कर दी गयी | हत्या करने वालों में स्थानीय दबंग पंचायत प्रतिनिधियों और बिचौलियों का नाम आ रहा है |

चर्चित कार्यकर्ता अंजली भारद्वाज ने कहा कि “जितनी भी भ्रष्टाचार से लड़ने के कानून हैं उसपर प्रहार चल रहा है | हाल ही में भ्रष्टाचार निवारण कानून में बदलाव किया गया , लोकपाल की नियुक्ति नहीं हुई है और सूचना के अधिकार कानून में बदलाव कर कानून को कमजोर करने की कोशिश हो रही है” |

निखिल डे ने कहा कि आधार लगाकर सरकार के पास लोगों के बारे में तमाम सूचना का अधिकार आ गया है पर हम जब सूचना मांगते हैं तो तमाम तरह की परेशानी होती है | बिहार सरकार तो गंभीरता से सूचना के अधिकार को लागू करना चाहिए | अब डेटा संरक्षण कानून के बहाने तमाम जरूरी जानकारी को छुपाया जाने की कोशिश हो रही है |

जन संवाद में आशीष रंजन ने कहा कि मामला गंभीर है क्यूंकि केंद्र और राज्य में सरकारें भ्रष्टाचार के खिलाफ आवाज बुलंद कर और सुशाशन के नाम पर बनी, पर आज वही सरकारें इन बहादुर लोगों की उपेक्षा कर रही हैं, उनकी हत्या हो रही है | जो आम नागरिक भ्रष्टाचार के खिलाफ बोल रहे हैं उन्हें सुरक्षा मिलने के बजाय निशाना बनाया जा रहा है | ऐसे नागरिकों की सुरक्षा के लिए बने Whistle-blower Protection कानून को लागू नहीं किया जा रहा है |

 

हालांकि इसी सब के बीच बिहार सरकार ने लोगों की शिकायतों को दूर करने के लिए शिकायत निवारण कानून, 2015 बनाया है | 20 से अधिक जिला से शिकायतकर्ताओं की जनसुनवाई जस्टिस राजेन्द्र  प्रसाद के सामने हुई |

 

सभी कार्यकर्ताओं के बीच जवाबदेही और पारदर्शिता को लेकर जन घोषणा पत्र तैया किया गया जिसमे यह कहा गया है कि किसी सूचना के अधिकार कार्यकर्ता की हत्या होने पर वहाँ एक विशेष उच्चस्तरीय ऑडिट कराया जाए |

 

इस कार्यक्रम का आयोजन सूचना के जन अधिकार का राष्ट्रीय अभियान, जन आन्दोलनों का राष्ट्रीय समन्वय, डिजिटल एमपावरमेंट फ़ौंडेशन और वीडियो वौलेंटीयर्स ने मिलकर किया |  इसमें कामायनी स्वामी , सोहिनी, अमृता जोहरी, महेंद्र यादव, उज्जवल कुमार, महेंद्र यादव, मणिलाल एवं कई अन्य कार्यकर्ता शामिल हुए |
