The complainant in the sexual harassment case against former TERI director RK Pachauri plans to move the Delhi High Court seeking a fast-track trial, her lawyer said.“The complainant does not want any further delay . The police took more than a year to file a chargesheet in the case and the court took nearly two-and-a-half months to take co gnisance,“ advocate Prashant Mendiratta told ET.
The lawyer said this case was a unique one “which deals with sexual harassment at workplace and its judicial outcome may have far reaching consequences for similar cases in future“.
Pachauri had denied all the allegations levelled against him by a 29-year-old former colleague at The Energy and Resources Institute.But a Delhi court on Saturday ordered the 75-year-old climate expert to appear before it as an accused in the case. The court also added wrongful restraint to the charges, which wasn’t part of the chargesheet filed by the Delhi Police. The statements given by the woman to the police and a magistrate, and form part of the 1,500-page chargesheet, probably led to the court adding the charge of wrongful restraint. In her statement to the police, the woman has accused Pachauri of once calling her to his room and hugging her forcefully from behind after closing the door. “I elbowed Pachauri in the ribs to escape out of his embrace and pushed him back,“ it read. The complainant’s statement to the magistrate said Pachauri would often stretch his arms suggesting her to hug him. “…even when I had spine injury, he forcefully hugged me in the office which I could not even resist due to my spine injury . I even wrote to him and email about his conduct,“ she said, according the chargesheet.
During a trip to Pakistan, the statement said, Pachauri tried to hug her.“In his room, he went down on his knees and said `main pyaar maang raha hoon (I am seeking love)’. When I started leaving, he opened the door for me and tried to hug me.
