Subject: Sexual assault on women protestors by personnel of Parliament Street police station

We are writing to demand your immediate action against police personnel of the Parliament Street Police Station who were involved in assaulting and brutalising a peaceful group of protestors today.

The facts are as follows.

  • A group of people belonging to the Dalit community from Bhagana village, Haryana, have been sitting in a peaceful dharna at Jantar Mantar for the last one month, in pursuit of their demand for justice in the case of abduction and gang rape of four minor girls. Early this morning, a large force of policemen appeared at Jantar Mantar and tried to evict the protestors who were sleeping there. pulled down their tent and scattered their belongings.

  • The Bhagana protestors (including the families of the rape survivors and the girls themselves) went to the Parliament Street Police Station this afternoon at about 1400 hours, in order to present a memorandum to the officer in charge asking to be allowed to stay in Jantar Mantar since they had nowhere else to go.

  • The Bhagana group was accompanied by representatives of women’s organisations, Dalit organisations and students’ organisations. The mothers of two of the rape survivors were leading the group.

  • The group was stopped by some policemen at the barricade outside the thana. Their request to be allowed to go inside and meet the office in charge was denied. Some policemen on duty at the barricade spoke to the Bhagana group in Haryanvi and asked them to go back and not to make trouble. The women argued with these policemen, insisting on being allowed to go and meet the officer in charge.

  • While the argument was going on, some policemen started pushing the group back from the barricade, using undue force and targeting the women by grabbing their private parts and pushing their hands into the anal region. The mothers of the survivors and several women activists (including Adv Pyoli Swatija of Samajwadi Jan Parishad, , Ms Sumedha Baudh of Rashtiya Dalit Mahila Andolan and Ms Rakhi – of NTUI) were attacked in this manner.

  • At this point a senior police officer (in uniform but without a name badge) came out and shouted out – “Are ye aise nahi manenge – lathi ghusao.

  • At this, some 4-5 women police charged forward and attacked the women by thrusting at their private parts with batons. The women who were in the front resisted this attack and struggled with the police women. Several policemen were also in the melee and were physically attacking women protestors.

  • Several activists were taken into custody and held for more than an hour, after which they

    were released without any charge being made against them.

  • None of the police had name badges except one police woman (Suman D) who removed it after a few minutes. However, we are confident that we can identify most if not all the attackers by face including the officer who gave the order for the sexual attack.

You are surely aware that the acts committed by the policemen and women are criminal offences under the Criminal Law (Amendment) Act, 2013.

We demand that the concerned police personnel (including the officer who gave the order for sexual assault) be immediately suspended from service and charged under the relevant sections. An FIR should be filed and an enquiry instituted without delay.

We are shocked to see that the police personnel under your command seem to have forgotten the bitter lessons of December 2012, and are blatantly ignoring and violating citizens’ rights of peaceful assembly and democratic protest.

We are told that much time and resources have been invested in training the rank and file of Delhi police in “gender-sensitive policing”. Our suggestion to you is: please do not waste any more of the taxpayers’ money on these futile public relations exercises. Instead, please take strong, immediate and exemplary action against personnel accused of such crimes.

We look forward to a response from you. We will be happy to come and present you with evidence in support of our complaint.

The new police commissioner says the victims should dial 103, following which a woman cop will visit their homes to register complaints.

In his first major decision after taking charge as the city’s police commissioner, Rakesh Maria has said that women victims of sexual assault need not visit police stations. The victims can now dial 103, following which a woman officer will visit their residences to register a complaint.

On Sunday, after taking charge, Maria said the safety of women and senior citizens, and zero tolerance towards street crimes, were a few of his priorities.

In cases of sexual assault, the already traumatised victims are forced to spend hours at police stations recording statements.

Last year, the gang rape of a photojournalist at the Shakti Mills compound shocked the city, following which it came to light that less than a month before the incident, some of the accused had also raped a teenage telephone operator at the premises.

“Many cases of sexual assault are not reported because the victims don’t want to visit police stations. They are already traumatised, and spending hours recounting the horror only adds to the agony. Hence, we decided to provide them an option to file a complaint at their residences,” Maria said.

In another major citizen-friendly initiative, the police commissioner said jurisdiction will no longer matter when it comes to complaints regarding someone going missing. For instance, the family of a person gone missing can file a complaint at any police station in the city.

“We are confident of putting the infrastructure in place to provide citizens with such facilities. The Mumbai police is extremely concerned about the safety of women, children and the elderly. We will also ensure street crime is curbed. These initiatives are a result of discussions with the officers,” Maria said.

The police commissioner also announced the launch of a ‘fast counter desk’ at all police stations, exclusively for women and senior citizens. “Every time a woman or a senior citizen visits a police station, they will be directed to the fast counter desk, where their grievances will be addressed immediately,” he said.

Maria, who spent many years handling the state Anti-Terrorism Squad (ATS), has an innovative idea to curb street crime: he has asked police stations across the city, and the Crime Branch, to draw up a list of 10 most dreaded history-sheeters from each area, and details of how they were being monitored.

“There will be a fortnightly review of all our initiatives, and any cop found not up to the mark will be dealt with. Several history-sheeters, including drug peddlers, are on our radar,” Maria said.

Already, the Mumbai police has increased patrolling near schools and colleges, shopping malls and railway stations, he said, adding that safe Mumbai was his number one priority.

  and outraging the modesty of a junior colleague, 80 days after his arrest, and could face imprisonment of more than seven years if convicted.

Police filed a 2,684-page charge sheet against Tejpal, in jail since December 1, under sections 354, 354-A (sexual harassment), 341 and 342 (wrongful restraint), 376 (rape), 376(2)(f) and 376 (2)(k) (taking advantage of official position and raping a woman in custody).

The charge sheet, filed in the court of Chief Judicial Magistrate Anuja Prabhudesai, has relied on emails and text messages between the victim and Tejpal, the statements of witnesses, besides CCTV footages of the 5 star hotel lobby outside the lift where the alleged incident happened.

Police examined 152 witnesses during the probe.

The charge sheet has placed great reliance on the “incriminating” emails exchanged between Tejpal, once celebrated for his sting operations, and the victim, including the one tendering apology for his actions, to nail him.

Later, briefing the media, Deputy Inspector General of Police O P Mishra said the Special Public Prosecutor in the case would request the trial court judge to conduct trial on a daily basis and conclude the proceedings within 60 days.

“Under section 309(1), this is an amended section (of CrPC), the Special Public Prosecutor, is going to request the trial judge to carry out the trial of the case on a day-to-day basis.

“As per the amended section, there is a provision that the offences which are attracted, which we have registered in this particular case, the trial should be completed within 60 days of the filing of the charge sheet,” he said.

Sunita Sawant, the Investigating Officer, has claimed in the charge sheet that the victim had identified the CCTV footage outside the lift. There was no CCTV camera fitted inside the lift.

The woman journalist was alleged to have been sexually assaulted by Tejpal on successive days on November 7 and 8 inside the lift of the hotel when she had gone to Goa for THINK Fest 2013.

The charge sheet has shocking details of how Tejpal, who knew the victim’s family for years, tried to allegedly force himself upon her on November 7 while keeping the lift moving from floor to floor without stopping.

The document contains in detail how the victim, who was drafted to chaperone Hollywood legend Robert De Niro and his daughter Drena, desperately reminded Tejpal that she was his daughter’s “best friend” to dissuade him from continuing with his obnoxious act, but in vain.

DIG O P Mishra said the Investigating Officer, who did a meticulous probe, had got in touch with the attorney of De Niro but the actor, who was travelling, had not responded.

“But we have enough evidence to prove De Niro’s presence at THINK Fest and all related documents,” he said.

The scandal involving one of the country’s top journalists became public after an internal email conversation in Tehelka got leaked, putting Tejpal’s career on the line.

In denial ever since the controversy erupted, Tejpal went into hiding and evaded the police for several days before giving himself up in the court of the Chief Judicial Magistrate in Goa after his anticipatory bail plea was rejected.

Tejpal claimed during the investigation that the incident was a “consensual act”, but police have charged him under the amended section related to the rape law.

Even while being in jail, Tejpal has been accused by the investigating officer of trying to intimidate her and by the victim of defaming her through an email.

The email contained the photograph of the victim with her face clearly visible, making public her identity which is against the law, and comments that she described as slanderous.

Meanwhile, the Goa bench of Bombay High Court will hear Tejpal’s bail petition tomorrow and may pass an order

Rajasthan High Court on Tuesday rejected the bail plea of spiritual guru Asaram Bapu, arrested for allegedly sexually assaulting a 16-year-old girl, a lawyer said.

Asaram, 72, is currently lodged in the Jodhpur Central Jail since September 2.

District and sessions judge (rural) on Monday extended his judicial custody till October 11 in the sexual assault case.

Asaram, 72, filed a bail application before the Jodhpur bench of the high court on September 13 after his earlier plea was rejected by a lower court.

“Justice Nirmaljit Kaur rejected his bail application today (Tuesday) after hearing arguments from the defence and prosecution lawyers,” said prosecution counsel Anand Purohit.

Senior counsel Ram Jethmalani had appeared for Asaram to argue in favour of bail.

On August 20, a 16-year-old girl lodged a police complaint accusing Asaram of sexually assaulting her at his ashram near Jodhpur.

Asaram was arrested from his ashram in Indore, Madhya Pradesh, and brought to Jodhpur on September 1.

Immediately after his arrest, Asaram filed an application for bail in the same court, which rejected the plea on September 4.

You recently met . How is she coping with her situation? Where does the case stand now?

I met  as well as her nephew – the  adivasi journalist,  – both in Jagdalpur jail as well as  court. Soni had six cases against her. She has been acquitted in four for lack of evidence and she’s already got bail in one case. There’s one more left though, where bail is pending. Ironically, in this case too, B K Lala, the alleged contractor who was to give the money to get his work done, as well as the manager of Essar company who is supposed to gain if there is such money are out on bail. The only two people who are still in jail in this case are and , who have no evidence against themselves. To my mind, as a lawyer, even if we admit the entire chargesheet – there’s no case to be made against either  or Lingaram. They are being falsely implicated and framed.

I speak for Linga and Soni, and they are asking, “Why are we being targeted, why are we being abandoned?” I think the answer lies in what the lady prosecutor said in a very brief argument in the court. Her argument was that all the offences were  made out against the accused. Secondly, that these were grave crimes. Thirdly, that it was a -affected area. As far I see it, the first one is her legal opinion. Second one is a statement of fact. Third one is not a statement that can be made in the court of law. Whether it is a -affected area or not should not influence a court of law. Each case has to stand on the basis of evidence presented to the court. In this case, the Unlawful Activities (Prevention) Act, Chhattisgarh Special Public Security Act as well as the charge of waging war against the state have been used to overwhelm the court – to make the court think that these are  leaders. They are only interested in continued incarceration.

Her husband Anil Futane died last month. There were allegations that he had suffered torture…

In Soni’s case especially, this state project of victimising adivasis has reached inhuman levels. At the court, I met her father, who had come walking on crutches. He had tied a piece of cloth on his foot, which had swollen. He has a bullet wound on his leg, which is not healing and the fate of the leg is not looking good. He was shot in the leg by Naxals as he had refused to be a  informer. ’s husband Anil Futane also had several cases against him before he got acquitted and released. He spent several years in jail and suffered torture. He died of ill-health – which must have deteriorated during his time in jail, owing to the poor diet.  wasn’t even granted an interim bail when her husband’s funeral was performed. They were all projected as Naxalites. Here’s a family that’s playing out the human tragedy that adivasis in Chhattisgarh are experiencing. They have three children – who have been destituted and are without any parental care.

In Soni’s case, how do we understand the way courts behaved and ask questions without inviting contempt?

I will not comment on the court that’s currently seeing the particular case. But in Jagdalpur, I met with a few judges and prosecutors to understand the situation here. I also met a lot of undertrials in jail. After conversations with judicial officers, lawyers, undertrials and prison officials, it’s clear that observations are the same – most of the adivasis in these prisons have been charged under what are called ‘ cases’. Off the record, these people will tell you, these adivasi villagers, whose village the Naxals visit, are not Naxalites. It’s undeniable that Naxals operate in those areas. The forces do not go into interiors and they do not risk keeping proximity to Naxals as they fear loss of life. The villagers are later picked up in large numbers. Witnesses don’t turn up to give evidence – not because they are petrified of adivasis – but because most witnesses are police and public officials. Hence these cases drag on and on for years. In south Chhattisgarh, the conviction rate in all cases is 3 percent. In this case too, what is the link the prosecution is making between Lingaram,  and the Naxals? Where is the criminal conspiracy? There is a line in the chargesheet without evidence or witness statement. It goes, “They have other  cases against them.” How can a court say I will convict you here because you have other cases elsewhere? The irony here is that they have been acquitted in all other cases. The two, who have nothing to do with the case, are languishing in jail.

PUNE: A 30-year-old speech-impaired woman, who was being treated at a hospital run by Pimpri Chinchwad Municipal Corporation (PCMC) in Moshi, was allegedly raped inside the hospital lift by a ward boy on the night of August 29.

The woman is an inmate of a shelter home. She told the officer of the shelter home about the rape on Saturday, after she was discharged from hospital.

Bhosari police have arrested the ward boy, Pramod Mandekar (28), a resident of Phuge Mane lane in Bhosari. They have also arrested a security guard of the hospital, Shailesh Jadhav (39), of the Nurses Quarters in Bhosari for allegedly helping Mandekar in the crime.

Mandekar and Jadhav have been charged under sections 376(D) (intercourse by any member of the management or staff of a hospital with any woman in that hospital) and 109 (punishment of abetment if the act abetted is committed in consequence) of the IPC.

Senior inspector Suresh Kekane of the Bhosari police station told TOI that the shelter home officer lodged a complaint against Mandekar and Jadhav. “Though the woman is speech-impaired, she somehow managed to give details about the crime to the officer. We also have some witnesses in the case,” he said.

PCMC health chief Dr Anil Roy however said that Mandekar is the watchman and Jadhav, the ward boy. Later in the evening, the police commissionerate confirmed that Mandekar had raped the woman.

“The victim had lost her parents a few years ago and is partially speech-impaired. She has been staying in a shelter home. On August 26, she complained of some heatlh issues and was admitted to the hospital,” said Sub-Inspector Sanjay Kandalkar of Bhosari police station.

Sub-inspector SS Kandalkar, who is an investigating officer in the case, said Mandekar was employed as a ward boy in the women’s ward of the hospital. “Around 8.30pm on August 29, Mandekar and Jadhav went into the ward and forcibly took the woman with them. Mandekar forced her inside the lift and raped her. After the crime, Mandekar and Jadhav brought her back to the ward,” he said.

Investigations have revealed that the lift operator had gone out on some work at the time of the rape. Mandekar has a spare key to operate the lift, a police officer from the Bhosari police station said.

Mandekar and Jadhav were produced in court on Sunday and remanded in police custody till September 4.

Meanwhile, women corporators from all political parties in Pimpri Chinchwad gathered outside the Bhosari police station on Sunday afternoon to condemn the rape. They demanded strict action against the suspects.

Jodhpur: Self-styled godman Asaram‘s supporters on Saturday allegedly attacked CNN-IBN sister concern IBN7’s reporters Bhawani Deora. Another IBN7 video journalist have also been injured in the attack.

This happened as Bhawani was reporting the updates in connection with thesexual assault case against Asaram. In fact, earlier on Friday, Asaram failed to catch a flight to New Delhi, after he was prevented from entering the airport due to a clash between his enraged supporters who smashed TV cameras and other equipment carried by reporters waiting for him, sources said.

As news about the Gujarat High Court not entertaining his plea for an anticipatory bail spread, Asaram suddenly left his ashram for the airport, to catch his flight.

IBN7 journalists attacked by Asaram supporters in Jodhpur, injuredOn Friday too, Asaram’s enraged supporters smashed TV cameras and other equipment carried by journalists in Indore.

However, due to a scuffle between Asaram’s supporters and TV news cameramen waiting at the airport over recording his sound bytes, his supporters could not enter the lounge to catch the flight.

Later, his supporters fought with reporters again and even resorted to pelting stones at the media, while Asaram’s whereabouts were not known, sources said.

Meanwhile, the arrest of Asaram now seems imminent after he missed the deadline to appear before the Jodhpur police for questioning in the sexual assault case of a minor girl. The self-styled godman sent a fax to the police saying he will not be able to depose before them for questioning.

According to reports, Asaram has reached his Indore ashram. The Jodhpur police have dispatched a team to Indore. Sources say Asaram is likely to be arrested after the questioning. Security has been tightened in the city. Rajasthan senior police officers have asked for protection for their team from the Madhya Pradesh Police.

Indore police have said that they will allow the arrest of Asaram if Rajasthan Police provides evidence against him. The police the law and order situation is under control.

The police on Friday refused to grant any extension to him. The police say they have several teams monitoring Asaram’s whereabouts to ensure that he does not escape.

“We have received a fax from Asaram’s ashram saying that he wants more time as there has been a death in his family. He claims he isn’t well. We have decided not to give him any more time. Our teams will leave Jodhpur to investigate the matter soon. If he is found guilty, he will be arrested. He has no defence,” Jodhpur DCP Ajaypal Lamba said.

Asaram had applied for a transit anticipatory bail application filed by him in the Gujarat High Court which he later withdrew after the court indicated that it would not grant him bail.

Asaram is accused of sexually assaulting a 16-year-old schoolgirl and inmate of his ashram. The 16-year-old minor’s father said his daughter is still depressed over the incident and explained why they went to Asaram in the first place despite knowing there were so many accusations against him.

“We thought he is a great man and we should become his followers,” the survivor’s father said.

Girl's father threatens fast-unto-death if Asaram is not arrested
The father of the minor girl accused the Rajasthan police of treating Asaram softly due of his political connections and demanded a CBI probe.
LUCKNOW: The father of the minor girl, who self-styled godman Asaram Bapu had allegedlysexually assaulted, on Friday threatened to go on a fast-unto-death if the accused was not arrested within 24 hours.

He accused the Rajasthan police of treating Asaram softly due of his political connections and demanded a CBI probe.

“With the police approach, there is little doubt that they would not conduct a free and fair investigation. We want the case to be handed over to the CBI,” the father told TOI from his residence at Azeezganj in Uttar Pradesh‘s Shahajahanpur district.

The Rajasthan police had summoned Asaram for questioning on Friday, a week after the minor lodged an FIR against him.

The godman has sought more time to appear before the police citing prior engagement till Aug 31. Reports quoting his son, Narain Sain, said he did not appear before cops on Friday as he was unwell.

“There was swift action when recently a girl was raped in Mumbai. The police flew down to Delhi and all the five accused were identified, traced and arrested within 24 hours,” said the father.

“But a fortnight after I had named the accused, who has raped my minor daughter, no action has been initiated against him. Why is this disparity? Is it because we are poor?”

He said they were forced to go underground after lodging the FIR because of their poverty. “We were getting regular threats from Asaram’s men. We are thankful to the Uttar Pradesh Police for providing us security,” he said.

“Despite all this, the accused is travelling across the country and nobody is stopping him. On the other hand we are virtually compelled to stay inside our house for the fear of being targeted.”

The girl’s father said he was a staunch disciple of Asaram and had so much faith in him that he donated his land in Shahjahnpur to build his ashram. “Today I feel cheated. He should be hanged for his crime and for cheating a disciple like me,” he said. “I used to follow him like my god and this is what he has done”

The family is particularly agitated over the godman and his son’s attempt to malign the girl’s character.

The family claims they have been receiving threatening calls from Asaram’s men, but they are determined to fight.

A regular contributor to Asaram Bapu’s trust, the father says he had taken his daughter to the spiritual leader as she had been unwell.

In her statement to the police, the girl said the 72-year-old yoga guru tried to force himself on her and threatened to hurt her and her family if she dared to reveal what happened.

Yesterday, the Rajasthan police waited for eight hours to serve summons to Asaram Bapu, as his followers claimed he was ‘meditating’. Later, Asaram Bapu dismissed the girl’s allegations as ‘bakwas (nonsense)’ and accused the family of trying to frame him.

“Will any man risk his daughter’s izzat (honour) like this by making false allegations?” said the father. “We stand by what we told the police. Why doesn’t the CBI investigate and verify the truth?”

He hit out at the police for only serving the godman summons, nearly two weeks after the complaint. “He has political connections – he should have been arrested by now”.

A two-member Rajasthan police team reached Indore on Tuesday morning to hand over summons to godman Asaram Bapu in connection with the sexual abuse case.

However, his followers tried to keep them away from meeting the saint under different pretexts. When the police team first called, the followers reportedly told it he was meditating and couldn’t be disturbed.

Indore’s Bhawarkuan police station incharge Ashok Tiwary confirmed that the ashram authorities had informed the Rajasthan police personnel that Asaram was in meditation and he would meet them after 2 pm. “Asaram has been asked to appear before Jodhpur police to record his statement within four days of receiving the summon,” he said.

It may be recalled that the Rajasthan police team was first scheduled to visit Asaram in Ahemadabad in connection with the case. But, he secretly went to his Indore ashram on Saturday prior to their visit, sources said. However, the Rajasthan police rescheduled their visit and reached straight to his Khandwa road ashram in Indore at around 8am on Tuesday.

Earlier on Monday evening, he appeared a bit relieved during the satsang at his ashram. He said he had decided not to seek anticipatory bail and claimed that he would give up both food and water, if arrested.

In another development, a local advocate, Inderjit Singh Bhatia, filed a petition in the local court here on Monday alleging that the religious sentiments of Sikhs had been hurt after Asaram Bapu allegedly compared himself with Guru Nanak. In his petition Bhatia demanded that all the ashrams of Asaram Bapu be sealed. The next hearing for the case has been fixed on September 28.
