In a 25-minute interview to Karan Thapar for The Wire, Dushyant Dave, a former President of the Supreme Court Bar Association, said “everyone has a right to be vaccinated for free” and then, more questionably, added “and it must be compulsory”.

Mr. Dave said the right to life, guaranteed by Article 21, includes the right to good health. “Health is central to the right to life”. Health, he added, is also at the moment the top most priority of the nation. Therefore, the right to a free vaccination for every Indian citizen is essential to guarantee and protect their health and without good health the right to life is left unprotected.

Mr. Dave said he has no doubt the government’s policy to charge people under 45 for their vaccines is a breach of the fundamental right to life conferred by Article 21.
